Tours Terms and Conditions

The Poindexter Descendants Association (“PDA”) is a non-profit association organized under Section 501(c)(7) of the Internal Revenue Code to offer historical education with a specific emphasis on the Poindexter family and for other purposes stated in its charter. Pursuant to this purpose, the PDA arranges meetings, reunions, bus tours, and international tours from time to time, including tours of the Isle of Jersey, England and France. The tours are open to PDA members, relatives, friends, and the general public. The terms and conditions described herein shall apply to all events arranged by the PDA, and the term PDA shall include its officers, agents, tour hosts and guides, members, and volunteers for all purposes herein.

Responsibilities
The PDA is not a tour company and is not being engaged by Tour Registrants as a commercial vendor. Rather, the PDA shall act on behalf of the Tour Registrants in the aggregate to arrange with vendors the itinerary, accommodations, meals, and sight-seeing to facilitate its educational purpose. The PDA does not provide the tour services being arranged and shall not be liable for the failure of paid vendors in performing tour services. The PDA also shall not be responsible for any accidents, injuries, illnesses, damages, baggage losses, expenses or inconveniences caused by any changes in arrival and/or departure times of plane, train, watercraft, or bus or by any other necessary changes of itinerary or accommodations or increase of rates, tariffs, or other costs effective after the publication of the information of a specific tour. Any such additional unanticipated expenses shall be borne by the Tour Registrants.

The PDA reserves the right to make changes or substitutions in the itinerary, on behalf of all Tour Registrants, if it becomes necessary or desirable to do so in the sole discretion of the PDA. The PDA reserves the right to decline to accept any person as a member of the tour. The PDA shall not be liable under any circumstances for any damages, personal injury, sickness, or losses arising out of any acts or omissions on the part of the PDA's officers, agents, tour hosts and guides, members, volunteers or Tour Registrants.

Refund Policy if you cancel
If you cancel your tour registration for any reason, your payment will be refunded minus a cancellation fee and any non-retrievable expenditures according to the following schedule. Your cancellation request must be in writing and shall be deemed effective when received. The PDA will work with vendors on behalf of the Tour Registrant to seek the return of the costs associated with your registration, including deposits the PDA made on your behalf to hotels and other venues. Prior to February 1, 2017, there is a two week grace period after your deposit is received to cancel for a full refund.  Outside of the grace period the cancellation fees are:

In the event a person who has been accepted as a member of the tour fails to arrive, does not attend, or leaves the tour for any reason, voluntary or otherwise, the PDA will be the sole judge of the amount to be refunded, if any.

Cancellation by the PDA
Tour Registrants are hereby advised that all tours have minimum and maximum participant numbers. The PDA reserves the right to withdraw any tour if insufficient enrollment, world conditions, or other reasons require such action. In the event the PDA withdraws a tour, all payments will be returned minus non-retrievable expenditures, regardless that the Tour Registrant is willing and able to proceed with the tour. By registering for the tour, Tour Registrant accepts and assumes this risk. Tour Registrants shall not assume that their travel companions will be accepted as participants of the same tour.

Travel insurance
All Tour Registrants are required to have comprehensive travel insurance to participate in this tour. Comprehensive coverage typically includes trip cancellation/interruption, medical, evacuation, baggage, and flight insurance. The Tour Registrant will be obligated to provide proof of insurance (certificate of coverage) or to sign a waiver that you take full responsibility before traveling with this tour, releasing the PDA from all obligations in this matter.  Tour Registrants will provide proof of travel insurance or an executed written waiver on or before May 1, 2017, or shall be deemed to have canceled their registrations as of May 2, 2017.

Passport and Itinerary
All Tour Registrants are required to provide to the PDA a copy of the photo page of their passport and their itinerary details (flight number, origination and destination airports and times) of their flights between the U.S. and European airports on or before May 1, 2017.

Costs, Amount Charged, and Contribution to Non-Profit PDA
The amount charged for educational tours is substantially the actual vendor costs of the tour, as allocated to each Tour Registrant. Group discounts are sought to reduce the cost to each Tour Registrant. Charges are imposed in addition to the actual vendor costs as a contingency fund to protect against fuel surcharges, currencies fluctuations, etc. and to cover general PDA costs and to advance the PDA.
